Application of Opinion N° 003-19-DOP-CC in food-related proceedings and the infringement of the principle of legal certainty

Abstract

This research analyzes the violation of the principle of legal certainty in cases of modification of child support in the canton of Riobamba, Ecuador, as a result of the implementation of Ruling No. 003-19-DOP-CC. It proposes filing a partial unconstitutionality action and developing legal guidelines to ensure judicial coherence, continuity, and the protection of minors’ rights. A mixed-methods approach was employed, combining qualitative analysis to identify normative, doctrinal, and procedural factors generating legal uncertainty, with quantitative analysis to measure the impact of fragmented judicial competence in terms of delays, duplicated procedures, and inconsistent decisions. A non-experimental cross-sectional design was applied during 2024–2025. The study had a descriptive-explanatory-propositional scope, allowing for characterization of the situation, identification of the causes of violation, and the proposal of corrective measures to strengthen the protection of the best interests of the child. Theoretical methods included analysis, induction, deduction, and a critical-constitutional approach, while empirical methods involved scientific observation, document review, interviews, and surveys. Results indicate that judicial fragmentation affects the predictability and coherence of decisions, compromising the effective protection of minors.

Judicial Assistant at the Chimborazo Council of the Judiciary since May 2013, where I have developed a solid professional career in the legal field. I graduated from the National University of Chimborazo in June 2014 and have acquired profound practical experience in the administration of justice for over a decade. This work represents an initial venture into the field of academic research, seeking to complement my professional career with a new analytical and scientific approach.

I am a lawyer in private practice for more than 9 years. Throughout my career as a lawyer, I have worked for several institutions in the national financial system, such as Banco del Austro S.A. as an external legal advisor, and the Cámara de Comercio de Riobamba credit union as a legal area assistant, and later as a legal advisor and compliance officer. Thanks to my performance, in 2024 the board of directors decided to appoint me as a subrogate manager. I began a new career path in April 2024 as an in-house lawyer for the San Jorge credit union, where I also perform the function of data protection officer, providing legal advice in all areas.

Graduated as a Lawyer in 2010 from the University of Guayaquil. Has served as a Public Defender. Obtained a Master's degree in Procedural Law in 2020 from ECOTEC Technological University.
