Abstract

This article consists in an analysis about direct and indirect prohibition error base on different theories that defines the correct application in the Ecuadorian criminal law. As a consequence, this article explain or describe wich theory applies in the Ecuadorian criminal law code.


The importance of this investigation is to learn wich elements make up each dogmatic categories of the crime theory, differentiating pure objectivity elements from evaluative elements. This will help sort out practical cases.

Pedro Andrés Crespo-Cabrera, Universidad Tecnológica Indoamérica - Ecuador

Lawyer of the Republic of Ecuador. He served as a criminal public defender for 7 years. Experience in lawyer attorney more than 2000 criminal cases. Co-author of the Transitional justice in the Havana agreements and their specificities, published by the Externado University of Colombia. Undergraduate professor at the Indoamérica University and postgraduate professor at the University of Cuenca and at the Instituto de Altos Estudios Nacionales. In matters of criminal and criminal procedure. Master in protection of rights with emphasis in criminal sciences and criminology from the Externado de Colombia University.
